My Wife and I attended an auction Christopher Desimone was responsible for as executor of the estate. There were 5 tracts of land and one with a home on it. We were the highest bidders on the home tract and the first land tract. This means we set the bar as far as pricing of the auction. The auctioneer said going once, going twice, Going three times and said a loud and clear SOLD for each of those two tracts. Where I come from, that is a binding contract. If any of us look that up on our phones or computers it clearly states that is in fact a binding transaction. The auctioneer Mr. Desimone hired for the auction did say something about how their could be some bundling in this auction but did not explain it so that anyone in the room of the auction understood it.. We were never referred to any documentation on the bundling process, I asked for that and was told it does not exist but they would explain it to us. After the final three tracts were auctioned off and people were filtering out the auctioneer announced they were taking the two tracts we won the bids on and adding another and reopening the bids at a additional 5%. We won the bids on the tracts we wanted and did not want the third additional tract so they took our two tracts away from us. Had the auctioneer documented the process we and every one else in the room would have known that tracts could be taken away from them. The Auctioneer definitely said SOLD at the end of each tract bidding cycle which to anyone in the room meant that was a binding contract. I don't want to tarnish anyone's reputation but My wife and I spent significant time researching the property and took time off from work to attend the auction only to have them waste our time with a flawed Auction process so they could get a few extra bucks. Hope this helps others avoid those wasted cycles..
