We hired CapCity law in Oct 2022 to address an easement dispute and health code violations. In short, our neighbors had placed their electric meter in the middle of our well access easement, had lived on site for 10 months in unpermitted structures with no means of sewage disposal, and placed a poorly-cared-for chicken coop approximately 20' from our well head. Attempts at reasoning with the neighbors had failed; specifically, when we asked if we could have a well driller drive around their meter to install our well the neighbor demanded we deed them a well as the price of passage -- a $26k expense. We were attracted by CapCity's offer of a collaborative approach and hired them to negotiate a reasonable solution to the well easement issue as well as shepherd code enforcement complaints through the County. Eight weeks later, CapCity acquiesced to the neighbor's attorney's claims that the neighbors could legally block any portion of the easement they chose so long as the one existing well could still be accessed for maintenance. They stopped work on the code enforcement complaints midstream, issued a final bill, and walked away. The neighbors immediately erected metal posts and chains to cordon off the remaining sections of the easement, effectively seizing it. We hired different counsel. He encountered a County unwilling to enforce code due to CapCity's mishandled initial complaint. Ultimately, we were required to expend nearly $30,000 in a nuisance suit to resolve these matters. Per our attorney, the cost would have been much closer to $75k had the neighbors not opted to sell their property and move away. In reviewing CapCity's legal work, our new attorney's comment was, "A lot of work went into a rather useless letter and a somewhat wrongheaded analysis of the easement." In reviewing the neighbor's attorney's positions, our new attorney's comment was, "This looks to me like he steamrolled her [Cap City Law] but failed to lock down the win with a settlement agreement." More importantly, CapCity's legal work made it both more difficult and more expensive to resolve our claims: "The soft-handed, soft-agreement approach of your prior counsel works against us here." In hiring Cap City Law, we made the mistake of mixing our politics with our pocketbook. Lesson learned. We should also point out that the neighbor's attorney had worked for Cap City Law until just a few months prior to our hiring the firm; we have made inferences from this but will leave it to the reader to determine whether this fact bears any importance.
