Mark was a tremendous asset for me. He gave me sound advice so I could make a decision.

I had a tough personal injury case (slip and fall.) I contacted Mark Kolter after my claim was denied. He was honest with me from the start about the difficulties of proving these types of cases. But after hearing me out, presenting my side of the facts, he agreed to take my case. I had 2 years of multiple surgeries on my neck and shoulder, PT, steroid injections, epidurals and on and on. It was the most painful 2 1/2 years of my life. Mark listened to me, and most importantly, believed in me. He was attentive, thorough and honest. It was a complicated and difficult case. But he guided us through it with compassion, kindness and respect. He was diligent, and with the help of the staff at the whole office, was in constant contact with us with updates and information to keep us informed on the status of our case. With his many years of experience and working dynamic relationships with professional contacts, he was able to create a relationship with opposing counsel in a respectful manner that only helped our case. After 2 1/2 years (from the date of my injury), we went to mediation and came away with a more than satisfactory settlement agreement. We could have chosen to continue to court, but with a 50/50 chance, and another year or two of court proceedings, we decided after thoughtful consideration, input from Mark and the experienced mediator, that the settlement was the best option. I had an extremely disappointing and disturbing experience working with Mark Kolter. He was very dismissive, a bad communicator, and did not thoroughly review medical documentation in order to prepare me for my IME. He recommended things that were useless and expensive multiple times, instead of recommending helpful actions. I could not rely on him at all to effectively navigate this process. He couldn’t keep his cases straight and was always forgetting details and getting things mixed up. When I tried to address these issues in a matter-of-fact way, he attacked my character by calling me a rude angry person and dumped me as a client instead of admitting to and trying to correct his mistakes. I recommend avoiding this firm, and especially Mark, at all costs.

It's a pleasure to recommend E. Darby Herrington as a thorough, empathic, and excellent lawyer. My recent experience with her began when I asked her to draft a pre-nuptial agreement between my husband-to-be, a Quebecer, and me, a US citizen. My husband's and my goal was to make it clear to all that my assets were to remain mine, in the event of death or divorce after our marriage, so that no one--especially my three sons--would suspect that this marriage was about my assets. Darby drafted a comprehensive and excellent agreement, which my husband was completely willing to sign. We then learned that pre-nups don't hold much weight given Quebec's division of marital assets laws. So, on Darby's advice, we turned in another direction, and drafted an irrevocable trust, placing the assets I identified into the trust, now held by my sons. This work required several meetings, my sons were present for some of them, and throughout, Darby listened carefully and produced the documents we needed to accomplish our goals. I will, without hesitation, use Darby's services in the future. One additional note: When I had a question about immigration law and in what country my husband and I should marry, Darby--not being well-versed in immigration law--gave me a referral that turned out to be excellent. I mention this because it's evidence of Darby's integrity, I think, that she doesn't pretend to know about things that she doesn't know about. I believe she's your best bet! --Otho Thompson
