Dauster, an attorney practicing in Fort Collins, Colorado, violated his fully binding Mediation Agreement by allowing the one or more of the parties to compel his testimony through deposition and seek to enforce a settlement that did not exist. This attorney/mediator further violated confidentiality in the mediation and failed to show a settlement agreement in writing and signed by the parties sufficient to record or file that would be enforceable within the Court. Dauster's violations and willful disregard for duties of care in mediation resulted in a costly appeal and subsequent years of needless litigation.
