While not getting back on my soapbox about how insurance companies appear to be taking advantage of employees under the "new" workers' compensation laws, I will say that I believe a well-informed employee stands a far better chance of receiving what they are entitled to under the law. Thank you Larry! As we discussed, numerous changes to the workers' compensation laws in Tennessee were implemented earlier this decade. The laws are no longer interpreted with a remedial construction. Which means, in the most relatable terms, a tie or close call no longer goes to the worker. Also, benefits have been drastically changed often times resulting in a significantly lower recovery for the worker. With those revisions, many long-time workers' compensation lawyers have fled the arena. I receive numerous calls where an injured employee is not receiving that to which he is entitled, but no lawyer will take the case. With that, I am a huge proponent of the ombudsman program through the Tennessee Bureau of Workers' Compensation. Often, workers can resolve timely issues through this program. An ombudsman may be able to help a worker obtain benefits, such as medical treatment, in a timely fashion through the program. That does not mean that you do not want to use an attorney at some point, but why not try that program at no cost first. Of course, you have to protect your case keeping in mind the one-year statute of limitation in Tennessee. I do still fight workers' compensation cases. And, I have a couple for which I will see little fee if any. The impairment ratings may be diminimus, resulting in little disability benefits upon which a lawyer is paid. The medical treatment and benefits are at issue. But, as a former defense lawyer for the insurance companies, I am appalled to see how employers are acting towards their employees simply because they have the money and resources and recognize that in a "small" case, the employer may struggle with obtaining representation.<br>Ok, I am off my soapbox. Thank you for your kind review Jason. I think it is important to provide information for folks who are genuinely looking for guidance in dealing with insurance companies on property damage claims. They better informed someone who has suffered a property loss, the better they will come out.
