Receptionist didn't even care to let me make an appt cuz im working! Rude! I have cancer, automatic disability! Smh! Shouldn't matter if I'm working or not to TALK to an attorney. Social Security evaluates Disability claims by using a 5-part test. The first part of the test is whether or not a claimant is working. Working has a unique definition-many people that are employed part time will not be considered "working" by Social Security. If you work enough hours (usually 35+/week) or have gross earnings above a certain amount ($1,690.00/month for 2026) for a long enough period of time (at least 3 months), Social Security will consider you to be working. If you are working under their definition, your diagnosis does not matter. Social Security will deny your claim at Step 1 of the five part test. Social Security does consider certain conditions to be automatically qualifying, but this occurs at Step 3 of the analysis. When people get denied at Step 1, Social Security does not continue to evaluate the claim. The claim is simply denied. Response-If you are not working under the definition I have listed above, then we should have scheduled an appointment. I would be happy to discuss your claim with you.
So frustrating! If I had known what type of "service" he provides I would have gone to someone else. When you call to get answers and you don't hear back from him for weeks! and so I called again and waited. By the time he finally called I had checked into the matter myself! So, at that time, when he called I should have told him then that his services were no longer needed! His assistance is nice(she gets the stars)but she doesn't have answers. So you wait, at least that was my experience, for Mr.Geary to call. Then there's the call before the hearing. I thought he would talk me through what was about to happen. He starts asking questions about my experience which I answered and then would have to correct him about what I just said. Then he starts to criticize me. Tells me that I was going to lose because of comments and a nervous laugh. So sorry I was nervous but if you've never gone through anything like this before you don't know what to expect. Since I did what needed to be done while waiting, I think I could have done what he did without his expenses. Treated me with what I consider an unprofessional attitude. Run from this guy!! Mr.Geary thanks for making me feel like a dumb ass.
I am sorry that you had a bad experience working with me. It certainly is never my intention to make a client feel bad. A Social Security Disability claimant has a very short period of time to make a good impression on the Administrative Law Judge. When I meet with clients in advance of the hearing, one of the things that I focus on is identifying any potential communication issues. Poor communication at the hearing is a common cause of denials. When I identify a communication issue, it is my responsibility to attempt to correct the issue. This can result in awkward and uncomfortable conversations with clients. I try to do this without making my clients feel bad and I am sorry that happened to you during your case. Set a flat rate for basic paperwork. Don't rob people by taking a huge percentage for yourself. I don't think you need to take a quarter of the money disabled people are owed in backpay. They need it more than you. It's only basic work that any paralegal can do.
Legal fees in Social Security Disability cases are capped at 25% of your backpay. No client of mine has ever paid me more than 25% of their backpay in legal fees. (This does not include expenses for out of pocket costs such as the purchase of medical records) Given the handle on your Google review, it would be impossible for me to verify what the nature of your contact was with my firm. Worked on my case for almost 2 years, I have epilepsy and it tends to be harder to get on disability. When we got turned down, Tim Geary was sure to get us back up n going! Attorney Geary and his staff are great people to work with, I would recommend them if you need help with your disability claim. Attorney Geary is very honest in what to expect as you go through the disability process, the steps you must take and the time it may take. His staff is excellent in making sure you have all the correct paperwork and can answer any questions you may have. I found this guy to be extremely rude and unprofessional over the phone. Told him my yearly income, (which IS below SGA sir!) & he says I'm practically working full time - and I wouldn't be willing to represent you. Seeking representation for a SSDI / SSI hearing?? Although I cannot discuss specifics in this forum, I would note that as your post alludes, working below SGA (Substantial Gainful Work Activity) does not render a person eligible for Social Security Disability benefits. Social Security can and does consider work below an SGA level to be relevant on an assessment of what a disability claimant can and cannot do with regard to full time work activity.
