Joe represented me for five years on an incredibly complex and contentious case. He is ethical and extremely thorough. Very few cases in my situation go to trial, but mine did. He expertly prepared me to be cross examined before a jury and handled my entire case with preparedness and knowledge.The case set legal precedent for people suffering sexual harassment in the workplace. Unless you have been discriminated against and have proof dont waste your time with Joseph. He took my case in an none discrimination suit. He charges 300 per hour. During the process he offered me a retainer fee where he would take the case and try to wrap it up in that time or 40 percent of the winnings. I wanted to do a retainer of 1000 dollars and 40 percent only if we won. He up sold me to 1500 dollars then 2000 dollars. He only takes venmo or a check, I used a card via pay pal and it cost me 5 percent extra even though he could take card and write it off as a business expense. He took the case, communicated by email, but just kept saying the business wasnt responding or was out on vacation for over five months. He charges every time you talk to him on the phone as part of the hours. After the business declined the beginning claim. Joesph said the case was 50/50 and would wait on my response whether I wanted to push on but he kept talking in circles trying to convince me to give up. Once I was ready to pursue 1 month later. Joseph wrote me an email saying he wouldnt go any farther. He claimed I owed him 400 or so more dollars but would wave them as a courtesy even though my contract with him said 2000 and anything after was going to be renegotiated. My impression of Joseph, he wants a quick very minimal effort win or he doesnt want to spend any time on a case. Dont waste your money on Joseph and find a lawyer that will be honest, let you talk and is willing to see thing through, Joseph in my case was not this lawyer.

Chris, I'm sorry you feel this way about my representation. However, some clarification is necessary. First, at the outset, I informed you of the potential roadblocks to recovery in your case and gave you the option of either hiring me on a contingency basis - meaning you pay me 40% of what we recover (the standard rate for employment law in Minneapolis) and zero if we don't recover anything - or on an hourly basis, which would require a retainer. You chose to pay me hourly, instead of on a contingent fee basis. While you may have wanted to pay a retainer of $1,000, I did not think I would be able to research your claims, draft your demand letter and negotiate on your behalf for that amount. Accordingly, I suggested a retainer of $2,000, which is the lowest retainer amount I will accept, and you agreed. You willingly signed a contract to hire me on an hourly basis. I attempted to keep the costs down for you as best as I could by using my law clerk (who bills at a much-reduced rate) for some of the research and communicating largely via email, which takes less time than over the phone. Any delays were caused by your former employer's failure to promptly respond to my attempted communications. While I can continue to follow up with opposing counsel to request a response - which I did several times - I cannot make them provide one any faster than they are willing to give it. Each time I received any information regarding the status of your case, I provided it to you immediately. While it is customary for attorneys to charge for phone calls, there are only two phone calls that appear on your bill. The first was a phone call with opposing counsel to discuss the merits of your case and the second was the last entry on your bill, which was a lengthy phone call with you, explaining the opposing side's position and your likelihood of success in the case. As you noted, I waived any applicable fees for that conversation. In that conversation, I suggested the both us take time to think about whether or not the claimed damages were worth the risk of pursuing in light of the facts of the case. After explaining to you what I thought the likely expenses on the case would be and the issues with successfully proving your claim, I chose not to represent you on a contingent fee basis and waived any additional fees you incurred under the hourly contract you agreed to. As I said at that time, you are welcome to find a different attorney who may view the case differently. Again, I am sorry to hear you're unhappy with your representation. I'm happy to speak with you about it in more detail at your convenience.
