Dear Mr. Sheffield,<br><br>I'm sorry you remain unhappy with my decision not to pursue your August 4, 2023 case, but I'm pleased you found another lawyer to assist you. As you will recall, I explained at the time that in order to provide the level of attention our clients deserve, are compelled to be very selective in deciding which cases to pursue. The fact that I was unwilling to pursue your case, despite having successfully represented you ten years earlier, was not meant as any sort of personal insult. I just did not feel your 2023 case met the strict criteria we adhere to.<br><br>Contrary to your claim that I "dropped [you] in the middle of a case," I communicated my decision to you, both over the phone and in writing, on September 23, 2023, a mere five weeks after your accident. Thus, you still had 23-plus months to find another attorney, which clearly you did.<br><br>Understanding that you remain upset about this years after the fact and despite what you reported to be the successful resolution of your claim, perhaps it will help you--and anyone reading your review--to read September 12, 2023 letter I sent you, in which I explained the reasons I was unwilling to pursue your case. As I emphasized repeatedly, this does not mean I think you are at fault for the wreck, but rather, I am simply saying that the available evidence would not allow us to convince a jury that the bus driver should be held liable. <br><br> We are constrained by Georgia law which requires the claimant (you in this case) to prove by a preponderance of the evidence that the bus driver was negligent and that his negligence caused the collision. If a jury were to conclude that it was 50/50, we would lose. To be clear, we need to show that it is more likely than not that the bus driver was the cause of the crash, and unfortunately, I do not see a path forward to proving that. Thus, as you requested, I am sending you this letter to formally terminate our attorney-client relationship such that you are free to consult with another attorney if you wish to do so.<br><br> Please note that the time within which you can bring a lawsuit for injuries you sustained in your August 4, 2023 accident is two years from the date of injury. Thus, if you choose to pursue a claim, you must be aware of this deadline, and if your case is not already resolved, you need to file a suit on or before August 4, 2025. Your failure to file a lawsuit prior to the expiration of the statute of limitations will bar your claim forever. I believe I have sent you everything from your file but if you feel there is any additional information, please let me know and I will do my best to get it to you without delay. Similarly, if you hire another attorney and that attorney wishes to speak with me, I am happy to do so.<br><br> Again, I am terribly sorry I was unable to do more for you and regret that things did not turn out otherwise. As you noted, Allstate, the at-fault driver's insurer, took a ridiculous position when it responded to our policy limits settlement demand by offering only a fraction of the at-fault driver's policy limits, not even enough to cover your medical bills. I know there were times when you wondered if it was worth the fight, but we held Allstate's feet to the fire, ultimately forcing them to pay more than six times their policy limits.
