I am a retired military officer who has practiced real estate law in Springfield for the last 30 years. Until recently, I had no negative Google reviews. In September 2023, Jenna Ferrell, an attorney, posted negative one-star reviews of my law practice and title company. Her claims in those reviews were false, misleading, defamatory, and unwarranted. When I learned of the reviews, I sent her a private letter giving her an opportunity to print a retraction and apology. Rather than comply Ms. Ferrell took down the reviews and then she, and some associates, posted multiple one-star negative reviews within days. In my opinion, this is a concerted effort to damage my reputation and business. <br><br>As early as 1888, the Supreme Court of Virginia recognized a claim for a conspiracy to injure a person in his trade or occupation. Under Virginia’s business conspiracy statute, a plaintiff must prove only three elements to state a prima facie cause of action, (i) a combination of two or more persons; (ii) for the purpose of willfully or maliciously injuring a plaintiff in reputation, trade, business, or profession; and (iii) resulting in damage to the plaintiff. The statute specifically allows for the recovery of triple damages and the costs of suit, including a reasonable fee to plaintiff ’s counsel, and without limiting the generality of the term, stated "damages" shall include "loss of profits." The statute also provides for damages if a plaintiff proves an attempted business conspiracy.<br><br>If you have seen, or see, the negative comments concerning my businesses from any of these individuals, and therefore decided not to use my services, or informed others who did not use my services as a result, please contact me.
