Update** although I appreciate Mr Malone's response, he did not personally review the case or the evidence nor His attorneys performance. This case was not a silver platter case but the evidence was there and still is there which is why two firms have picked up the case and are moving forward. Pointing out the one stars that I left on the other two firms as a defense is just bad form. I read all of Dean Malone firm reviews before I decided to consult with them to take my brother's case who he died in police custody. I was disappointed when the attorney informed me that they did not view all of the video footage but read the report from the Ranger who investigated my brother's death and took it as unwavering fact. I believe that any investigator worth his salt good reviewed the limited body camera footage that was given to them and matched it against the rangers report that a discern for themselves that the Ranger wasn't being completely transparent or objective with his reporting and would have put no weight to that report and done their own full and thorough investigation. The counties blatant resistance to turn over all evidence of audio and video of my brother's arrest and death from Dean Malone's firms freedom of information request should have been the first red flag for them to dig harder and examine the evidence further but it did not. A lot of the evidence was as plain as day but I felt it was disregarded and was told that it wasn't enough. Their own doctor told them that my brother didn't die of an overdose but died of intestinal ischemia which is a very long and painful 6-hour death all which was detailed and the jailers observation log which outlined and timelined his symptoms and again that evidence was missed as well. I had to investigate my brother's case on my own, I have a military intelligence background, and it didn't come without any consequences for myself. I'm now on three different types of medication and see it as psychiatrist after witnessing my brother's death and having to investigate it on my own. Any good investigator could have concluded where the evidence viewed independently doesn't add too much but when placed together as pieces of a puzzle tell the story of blatant disregard for the health and safety of my brother which prevented protocols from being activated that are set in place to save inmates lives. Two firms have teamed up to take my brother's case and I said to have a discussion with the district attorney here in the next week and depending on how that conversation goes who determine if we go to settlement or go to lawsuit and they have the shared me they have the lawsuit already drawn up and ready to file. We lost almost a year with Dean Malone. Had I went with this second firm the first time we'd have more time to find more evidence. A good investigator goes a long way. Maybe hire somebody with an intelligence background.

I will not comment on evidence related to your brother's death, so as not to compromise your efforts to work with other lawyers, but there is at times evidence which is dispositive of a case.<br><br>It can be the cause of death, or whether jailers did or did not do certain things. Our firm knows these cases well, including the very complicated law applicable to them, and we have a reputation among lawyers in Texas for being a go-to firm for jail death referrals. Again, without regard to your brother's case, we have no reason to not proceed with a case if we think that that the case has merit. We are also ethically obligated not to file a case that we think does not have merit.<br><br>The law applicable to jail death cases is convoluted and best applied by lawyers who handle these types of cases. It is likely why we receive attorney referrals generally weekly. We know what we are doing handling jail neglect cases. I can understand that you are not pleased that we we unable to file suit for your brother's death. I might feel the same way in your shoes. But our decision does not reflect on our competence or tenaciousness in litigating cases our law firm has agreed to file. And our reputation handling these types of cases speaks for itself.<br><br>You also mention that the county stonewalled us in obtaining evidence. This is nothing new and happens in almost all of our jail death cases. Counties assert objections available under the Texas Public Information Act, but we are experienced in navigating such objections.<br><br>I do not want to question your motives for leaving us a 2-star review, but it has been months since we represented you. I also saw that you left 1-star reviews for two other law firms.<br><br>Response to your update: I review and discuss with an attorney in our office every jail death case before we decide whether we can ethically file a lawsuit or instead whether the evidence does not allow us to do so. I personally draft all new lawsuit complaints. So your assertion is not true. And whether there is a law firm or several law firms who are willing to take a case says nothing about a case’s merit. It is one thing to take a case. It is another to successfully litigate it.
