I was hired by Victoria regarding a civil suit against her in 2022 and in which there was a time crunch. Case Number: 20D02-2203-PL-00006. <br><br>I entered my appearance on April 25, 2022 as well as Answers to the Complaint, Affirmative Defenses, Answers to Plaintiff's Request for Production of Documents, Request for Trial by Jury, and Request for Production of Documents amongst other things. <br>I withdrew my appearance on 1/30/2023 because Victoria failed to cooperate with her case. <br>The case was transferred to Superior Court No. 1 on January 31, 2023. 20D01-2203-PL-00006. Victoria begged me to take her back and that she would cooperate with her defense, stay in contact, and produce answers and documents to Plaintiff's discovery requests. I re-entered my appearance on 4/26/23. On 7/27/23 I again filed to withdraw my appearance as Victoria would not cooperate in her defense and would not provide me with discovery documents and answers to requests that were needed. Victoria then hired another attorney. <br>Summary Judgment was filed against Victoria and opposed by her counsel. On 6/3/25 (two years after I withdrew my appearance) Summary Judgment was granted in favor of the Plaintiff and against Victoria. She is appealing that judgment. <br>I withdrew on Victoria's case because she failed to cooperate, she failed to answer discovery, and she failed to pay money that she owed me. Yes Victoria I charge for my serves and yes I expect to get paid. When you go to work, at the end of the week you expect to get paid. If not, you are not going to work there much longer. You should also follow the Agreement for Legal Services, follow your attorney's advice, communicate with your attorney, and get your attorney all the discovery documents and answers in a timely manner. <br><br>My focus is on helping people with their legal problems. Forrest Ludwick II hired me to represent him on March 15, 2019, Ludwick did not pay his retainer so I withdrew my appearance on his case on July 10, 2019. Ludwich subsequently was divorced on October 6, 2022, 3 years and 3 months after I represented him and after he went through several lawyers. In a dissolution of marriage the presumption is a 50/50 division of assets and debts. I don’t know what Ludwick means when he states that I rolled over and did nothing to help him or protect him from his ex-wife or her attorney.<br><br>With regard to the criminal case I represented Mr. Ludwick for a level 6 felony and a class A Misdmeanor that being Strangulation and DomesticBattery in which Ludwick's then wife was the victim. And because of Ludwick's criminal actions against his then Wife it effected his custody and parenting time. It was not due to my representation of him, it was due to the repercussions of Ludwick's own actions against another human being, that being his wife in front of a minor child. <br>In a criminal case the defendant has a choice of a trial by jury, a bench trial, pleading guilty without benefit of a plea agreement, or accepting a plea offer. As in any criminal case I am required to present any and all plea offers to a client. <br>Mr. Ludwick was presented a plea offer and he accepted it. I never force or coerce any client into doing anything. I advise them of their choices and the possible outcomes of each and it is upset to them to decide what they want to do.<br><br>Mr. Ludwick is upset because he owed me money on his cases so I turned him over to collections and they are garnishing his wages.<br><br>My focus is on helping people with their legal problems. Emersen Earhart is a liar and if she does not delete this post defaming me, she may find herself in Court again. Earhart is mad because I sued her for the outstanding attorney fees that she owed me and I was not only awarded by the Court the fees that Earhart owed me, but additional attorney fees for a total of $4,765.00 on September 6, 2024. I have not been Earhart’s attorney since December 15, 2022 (today is 9/11/24) for almost two years and as soon as I sue her and get a judgment against her in a court of law, she posts a negative review full of lies against me. Funny how that works.<br><br>I was like the 4th or 5th attorney that Earhart had hired. Earhart believes that everything is someone else's fault, it's the guardian ad litem's fault, it's the attorney's fault, it's the judge's fault, it's everyone's fault that Earhart doesn’t get what she wants, except for Emersen Earhart.<br><br>Emersen Earhart is lying about everything in this review. <br>1. My billing is accurate and true. I billed her for work I had done, and I didn't bill her for everything I could have which was reflected on her invoice.<br>2. I have a email from Earhart admitting that I did a good job, that she owes me the money I billed her for, but that she didn’t have any funds to pay me for work already performed.<br>3. I knew the issues and just because Earhart didn’t get what she wanted, she is upset.<br>4. Regarding paralegals, I have had 2 paralegals in the last 8 years. Earhart believes that when <br>an intern requests to work for me for a semester or two to get college credit that this is a paralegal. <br>5. I did not bill Earhart for reviewing medical records. I did bill Earhart for downloading, <br>Printing off, reading, and reviewing the voluminous records from Harmony House.<br> 6. Earhart is lying that I didn’t know her Husband's name. <br> <br>Earhart states that she had better luck pro-se, however I read the August 6, 2024 Court Order and clearly did not go Earhart's way. Earhart calls me Marty instead of Attorney McCloskey which clearly indicates that she is comfortable with me and I invested a great deal of time on her case. This also shows that she liked and respected my work until I sued her in Court for my attorney fees.
