For $350 an hour I expected to have the laws surrounding my case explained. They didn't go past my first "why". I tried restating my central, single question different ways several times. They wouldn't answer. It was more institutional gas lighting. Essentially they said they couldn't take my case because the people doing the bad thing kept doing the bad thing for a long time so it is ok. But they didn't sufficiently explain why its ok to break the law as long as you keep doing it or when it becomes ok. <Update>: Thank you for helping me make my point. I was worried people might think I was being woke and disgruntled. As I said. If someone keeps doing the bad thing (as all bullies do until stopped) then how has the statute of limitations passed? You wouldn't explain this to me. I feel for $350 I would at least get that answer. I feel a good lawyer would be able to make the case. If I were embezzling money for years, no one in their right mind would say that was legal because they set the date of the statute of limitations to the first date the embezzling started. This is pure logic. I was under the belief that lawyers were trained in logic. Hence, I believe some other motivations are involved. This is only logical. It also speaks to the fitness of the lawyer. You should have been able to provide a concrete example that made sense. You cannot. </end update> As is the case with gaslighting, the first run through it is very polite. As I pressed the issue, asking the question in different ways they remained polite but became dismissive. I was charged for a full hour at an exorbitant rate even though I was finally dismissed before my hour was up. After the first half hour I got the feeling I was being managed vs. treated respectfully or seriously despite the grave details of my case. In retrospect I should have read the law firms' posted bios before shelling out that kind of money to ask a bunch of Ohio State Alumi to start a case against OSU.
Unfortunately, both federal and ohio law requires that legal claims, including claims of discrimination and retaliation, be brought within a specific period of time after the discriminatory or retaliatory act has occurred. This is called a statute of limitations. If a statute of limitations has expired, then no legal action can be brought. In this instance, while we attempted to explore multiple potential claims during the consultation, among other issues, the statute of limitations in which to bring the majority, if not all, of those potential claims had already expired. It is our practice to be direct and forthwith with our clients because entering into any type of litigation is a significant commitment of time, finances and emotion. Unfortunately, some times, as we were required to do here, we must tell a potential client that he or she does not have a case.
