Thank you for taking the time to write this review but it does warrant a response because my office is confident in the representation that Mr. Smith and you, his girlfriend were provided. Mr. Smith and you were originally charged in September of 2018 with enhanced Felony trafficking (enhanced b/c a firearm was present) after a search warrant was executed on your all's residence. Three additional charges of endangering the welfare of a minor were also placed against Mr. Smith. Ultimately, Mr. Smith pled guilty on November 8, 2019 to the enhanced trafficking and in exchange for his plea, our office successfully had your felony case dismissed completely. Also, we were able to have the three counts of Endangering the Welfare of a minor dismissed against Mr. Smith as well. For that case, Mr. Smith's sentencing date was originally set for January 23, 2020. Unfortunately, prior to his sentencing, on December 19, 2019, Mr. Smith was charged again with Felony Fleeing and Evading the Police, Felony Wanton Endangerment of a Police Officer, Felony Trafficking, and Felony Tampering with Physical Evidence. These charges stemmed from a traffic stop that Mr. Smith fled from where he almost struck a police officer and pedestrians in the area. Due to these new felony charges, Mr. Smith's sentencing in his first case was continued and moved. Less than two months later, on February 12, 2020, Mr. Smith was arrested again in Ohio and charged with Felony drug possession and an assortment of other charges. After being charged in Ohio, I assisted Mr. Smith in finding an attorney in Ohio to help him with that case. During the pendency of all of these cases, our office was successful in not getting his original bond revoked on his 2018 case. In fact, Mr. Smith stayed out on bond throughout most of 2020. On December 11, 2020, Mr. Smith was formally sentenced in his 2018 case where he received the minimum sentence for the enhanced drug trafficking. Due to his new and similar charges while that case was pending, the Judge denied Mr. Smith's request for probation and ordered him to prison. However, our office was successful in delaying his report time to prison until after the Christmas holiday so that he could spend that time with his children and family. Prior to that sentencing, Mr. Smith pled guilty in his second Felony case to one count of Fleeing and Evading, one count of Wanton Endangerment of a police officer, and one count of trafficking. In exchange for his plea our office was able to get his felony count of Tampering dismissed. His sentencing in that case was set for January 22, 2021. At that sentencing, Mr. Smith was denied probation due to already being incarcerated and received the minimum sentence on the Fleeing count (1 year), two (2) years on the Wanton count, and the minimum sentence on the trafficking count (1). Because this offense was committed while he was out on bond for his first case, this prison time by law had to run consecutive to his first case. On April 21, 2021, I filed two motions for shock probation - one motion for each of his felony cases in Kentucky. Both motions were denied by the separate Courts / Judges mainly because Mr. Smith had been charged with three separate serious Felony cases across two states. At that point, my representation ended.<br><br>My office vigorously represented Mr. Smith in his felony cases in Kentucky, filed extensive sentencing memorandums and shock probation motions and believe that we achieved the best result possible for him.<br><br>It does appear that a text message in June was missed from you regarding how to transfer a motor vehicle title. A phone call from you on July 8, 2021 was missed while I was on a vacation during the 4th of July week.
