I was fortunate enough to have Tim McDonough represent me and my wife after an accident. Tim set up medical appointments, took care of the billing, and always answered our questions every step of the way. He has a great network of doctors who won’t keep you waiting weeks or months for appointments. I really like that Tim answers phone calls, and emails, unlike most lawyers who will either do not return calls or whom you may never even speak to. Tim is the second auto accident attorney I’ve had to use, while I think the first lawyer did great, I think Tim is an excellent attorney who can not be compared. I would most certainly recommend Tim McDonough to anybody who gets into an accident, he doesn’t bs you, takes care of business, makes sure everything is squared away, and get you what you deserve!

To be Fair and Honest, I will preface this review as my having mixed thoughts/feelings re: service(s) of Attorney/Mr. McDonough. Pros: Pleasantly surprised and satisfied with Final settlement. Cons: Improvement in Customer Service, i.e., (1) Preferably in my case, I would have preferred more consistent update communications. (2) Not so much as to what was said as to how it was said. In one instance of communication via phone, his demeanor/comments, I felt verbally abused; which turned me off from wanting &/or need to speak with him directly. After which, my chosen method of further communications with him was via emails and US Postal Service. (3) Initial contact, personally felt rushed and overwhelmed to sign on. Having paralegal training, initially I did some of the earlier legwork (obtaining DMV documents, medical attention and reports, photo copies of damages, provided insurance claim information as it related to the rental car I was driving at the time. Conclusion: Hopefully, this was my first and last need for any attorney services.

I used Mr. McDonough on 2 different cases on for my wife and one for myself and i was 100% happy with the results.

My biggest mistake was calling this pompous, egotistical, moronic, and incredibly unprofessional attorney Tim McDonough. A simple question turned into three minutes of berating me, telling me I don't know what I'm talking about, I can't just call up an attorney and ask a question, I need to just figure out if I want to hire one or not, because I have no idea what I'm talking about and there's no such law in regards to what I'm saying. I called Russ Brown right after and they were beyond kind and informative. They answered my question immediately. They confirmed exactly what I was talking about. Mr. McDonough I've included the formula I had mentioned, you can site the Supreme Court cases yourself since I don't know what I'm talking about. I've acted as my own attorney in 3 separate cases that have settled for well over the amount I would have received had I acquired an attorney. Tim McDonough is the type of man that insults your capabilities due to his overwhelming feeling of insecurity that you can do his job without having to be an attorney. I wouldn't recommend him to anyone seeking representation or advice. Recovery rights and negotiation strategies Medi-Cal is entitled to recover from both third-party and uninsured/underinsured motorist policies and required by federal law to seek recovery of payments made.8 While DHCS usually asserts a lien, DHCS can institute legal proceedings to recover the reasonable value of benefits provided against the liable tortfeasor or insurance carrier directly.9 Thus, even if a Medi-Cal recipient decides not to pursue an action against the liable party, DHCS can still obtain reimbursement for the benefits it extended. Medi-Cal is only entitled to collect on treatment up to the date of settlement.10 Unlike with Medicare, there is no provision for recovery for future medical treatment at this time. In the right case, this can prove important with regard to timing of treatment. If a surgery can be delayed until after settlement, that amount will not be included in the lien amount. You will want to confirm that your client will still be eligible for Medi-Cal benefits at the time of the treatment. On the other hand, if no further treatment will be required and thus, Medi-Cal will not be spending additional funds on the injury, remind them of this fact, especially if pursuing a reduction under section 14124.76. DHCS is required by statute to reduce its lien. The reduction required depends on the value of the claim, settlement amount, lien amount, attorneys’ fees and litigation costs. Pursuant to section 14124.785, DHCS’s recovery on its lien is limited to the least amount from applying section 14124.72, 14124.76, and 14124.78.11 The 25 percent rule The most DHCS is ever entitled to in reimbursement is 75 percent of the benefits it provided. Section 14124.72(d) requires DHCS to reduce the lien by 25 percent for its share of attorneys’ fees and a proportional share of the costs.12 Example: Settlement: ................ $50,000 Lien: .......................... $10,000 Attorneys’ Fees. $15,000 (30%) Costs:.................................... $200 Lien after reduction: ($10,000 * 25%) – [$200 * ($10,000/$50,000)] = $7,460 The 50 percent rule In no case is DHCS entitled to receive more of the settlement funds than the beneficiary after reduction for attorneys’ fees and costs.13 In our previous example, if settlement was in the amount of $15,000 instead of $50,000, attorneys’ fees would be $4,500, and the amount due to the client would be $10,300. DHCS would be entitled to no more than 50 percent of this amount, or $5,150. It is important to run both the 25 percent and 50 percent calculations to ensure the correct reduction is applied.
