Dear Tashianna, hope you are doing well. It has been a long time. I assume your review is based on the result of your case and not the legal services. I too was disappointed with the result. In general, a slip and fall case can be very challenging. In Oregon, in order to prevail on a slip and fall case the injured party must prove that the owner or an employee of a company was negligent by failing to remove an unsafe condition, AND that unsafe condition was the cause of injury. If an injured party cannot prove the existence of an unsafe condition—i.e., that the company knew of or should have known of—or that the unsafe condition was the cause of the fall, the claim will fail as a matter of law. Simply because a person was injured does not mean the company was negligent if an injured party cannot prove the elements of the claim. I certainty would never advise a client to pursue a claim to trial where the evidence could not establish a basis for liability. Otherwise, the client could ultimately be liable for the other’s side costs. I know it has been a long time since we talked, but please call me so that we can discuss in further detail
