Our approach to personal injury cases is first to ensure that clients reach their maximum medical improvement before proceeding. For readers who don't know the term, "Maximum Medical Improvement (MMI)" is when the covered illness is stabilized and is unlikely to improve with or without additional medical treatment. There should be no rush to a settlement because unforeseen medical expenses are generally much higher than a settlement. No use suffering in the future should treatment become necessary, but then be unaffordable. Everyone should be concerned if they are pushed by anyone to settle quickly. Dear ch, while we are unable to comment directly to your view of matter, since you didn't identify the matter, and even with that information we would not publicly address claims for fear of breaching attorney/client privilege, please understand that various factors beyond just financial considerations come into play when a lawyer considers taking on a case. <br>Here are some key issues:<br>Likelihood of Prevailing: What is the likelihood of succeeding in the case, and if we prevail, what is the value of an award to the client? <br>Cost-Benefit Analysis, Incorporating the Likelihood of Prevailing: Where a client seeks a contingency agreement, Lawyers evaluate the financial aspects of a case before taking it on. If the upfront costs (such as preparation and court presentation) exceed the potential recovery amount, they will almost certainly decline the case. Other costs in addition to the attorney’s time to consider, to name but a few, include expert fees, deposition costs, medical evaluations from multiple doctors, travel costs, office staff support and so on. For injunction and appeal cases, the cost of a required bond is implicated. Correspondingly, especially when a Lawyer declines to accept a case on a contingency basis, scrupulous ones won’t take a case on a client-pay basis - in recognition that the cost to the client would exceed the potential recovery amount. Lawyers oftentimes perform a favor for a potential client by not accepting a case. Especially at a time when the potential client may be experiencing trauma and not thinking clearly. <br>Effective Assistance of Counsel: An attorney, after hearing enough facts, may realize they are not equipped to handle the case because it falls into an area of law in which they do not have proper experience. <br>All legal decisions involve a complex balance of factors.
